1 โ€“ Legal information


The website www.delsey.com (hereinafter referred to as the "site"), including its online sales area, is the property of DELSEY, a simplified joint-stock company with share capital of 52,099,596 euros, whose registered office is located at 12 rue Duhesme, 75018 Paris, registered with the Paris Trade and Companies Register under number 572 017 507, whose intra-Community VAT number is FR 22 572 017 507.

DELSEY is a company specialising in the manufacture and distribution of luggage items on its own behalf and/or on behalf of third parties.

2 โ€“ Preamble


The purpose of the site is notably the sale of DELSEY-brand luggage items (hereinafter referred to as the "product(s)") to customers acting in the capacity of consumers.

3 โ€“ Definitions


The terms defined below shall have the following meaning between the parties:


"accessory/accessories": any product sold on the site that cannot be qualified as luggage;


"customer": any natural person acting for purposes that fall outside the scope of their professional activity and who purchases a product on the site;


"delivery charges": delivery charges are covered for any order over โ‚ฌ99. For any order under โ‚ฌ99, the charges are as follows:

France: โ‚ฌ9.90 Belgium: โ‚ฌ14.90 Luxembourg: โ‚ฌ14.90


"return charges": the charges relating to the return of a product are covered by Delsey, subject to compliance with the procedure referred to in paragraph 14.2 hereof.

4 โ€“ Purpose


The purpose of these terms and conditions of sale (hereinafter referred to as the "T&Cs") is to define the terms and conditions of sale of the products offered on the site. They govern all the steps required to place and track an order.

All sales transactions relating to these products presuppose that the T&Cs have been consulted, understood and accepted.

The T&Cs apply to any purchase of a DELSEY product made within the territory of metropolitan France.

5 โ€“ Prerequisites


The customer declares and acknowledges:

That they are of legal age and have full legal capacity enabling them to enter into commitments under the T&Cs; That acceptance of the T&Cs and of the order for the products takes the form of consent by "click"; That they are acting as a consumer, meaning that the acquisition of the products is intended exclusively for their personal and private use.

6 โ€“ Enforceability of the T&Cs


The version of the T&Cs enforceable against the customer is the version accepted by them at the time their order is confirmed.

DELSEY reserves the right to adapt or amend these T&Cs at any time. However, the new T&Cs shall apply only to orders placed after they are published online.

7 โ€“ Conditions of access to the site


DELSEY endeavours to provide quality access and to enable users to use the site and the features made available to them under the best possible conditions. DELSEY reserves the right, without notice or compensation, to close the site or access to one or more remote services temporarily or permanently, in particular in order to carry out an update, maintenance operations, amendments or changes to operating methods, servers and access hours, this list not being exhaustive.

DELSEY is not liable for damage of any kind that may result from these changes and/or from a temporary unavailability, or from the permanent closure of all or part of the site or of the associated services.

8 โ€“ The right to refuse orders


DELSEY reserves the right to cancel an order in the event of existing dispute(s) with the customer, or of total or partial non-payment of a previous order by the customer, or of a technical problem leading to the display of a "derisory" price compared with the product's reference price (the reference price of a model being the price stated in the catalogue of the current collection).

DELSEY also reserves the right to refuse any abnormal order for the same item, or for items in large quantities, that would not be consistent with the pursuit of a non-commercial purpose.

It is specified that certain products may not be available for sale in certain countries.

9 โ€“ Product information


The greatest care is taken in publishing online the information relating in particular to the essential characteristics of the products offered for sale on the site, to prices, to guarantees and after-sales services, to means of payment, to payment and delivery terms, to delivery restrictions, to the period during which the spare parts essential to the use of the goods are available on the market, and to the possibility of using a consumer dispute mediation procedure, all of this information being available prior to the placing of the order.

The photographs and other graphic illustrations of the products presented on the site are for indicative purposes only. The customer is fully informed that the images, photos and colours of the items offered for sale may in particular not correspond exactly to the actual colours, owing to the effect of the internet browser and screen used.

Product information is provided subject to material errors.

10 โ€“ Ordering process


10.1 โ€“ Choice of products


The customer chooses from the products presented on the site on the day of the order.

It is specified that placing a product in a "wish list" does not constitute a reservation of the product, and that the customer must check that, at the time the order is placed, the product is still available.

Products that are out of stock appear greyed out on the website and cannot be ordered.

The customer is required to ensure that the purchase of an accessory on the DELSEY site is compatible with the product for which they wish to use it.

10.2 โ€“ Process for ordering a product


Any order implies full and unreserved acceptance of the T&Cs by means of a checkbox and a "click".

The ordering procedure comprises the following steps:

Step 1: choice of products and filling of the basket; Step 2: access to the basket details. At this step, the customer has the option of checking the details of their basket and its total price, excluding any delivery charges, of amending it and/or of removing products. It is at this step that the customer will have the option, where applicable, of entering a promo code and/or a gift card code; Step 3: Order summary; Choice of delivery address Step 4: Choice of shipping method (any delivery charges are then indicated); Step 5: Choice of payment method; Choice of billing address Step 6: Confirmation and payment of the order, including acceptance of the T&Cs.

Once confirmed and paid for, the order can no longer be amended by the customer, subject to the provisions of paragraph 14.1 of the T&Cs.

DELSEY acknowledges receipt of the customer's order by sending an email.

No order will be taken into consideration until payment has been accepted. Any rejection of payment will entail cancellation of the order.

DELSEY undertakes to fulfil the orders received subject to available stock and, in the event of unavailability, to inform the customer by any means; the order will be cancelled and the sum corresponding to the order refunded directly to the customer's account.

11 โ€“ Prices


Prices are valid only for the period during which they are accessible in real time in the online sales area. They may change according to several criteria, in particular in the event of commercial operations, etc.

The value of the transaction will necessarily be that of the date and time of the customer's order.

Prices are displayed in euros, inclusive of all taxes.

The prices displayed on the site do not take any delivery charges into account.

Before the customer confirms the order, the total amount of the order will be indicated (price inclusive of all taxes + any delivery charges). And if a product were to be subject to the eco-contribution provided for by the French Environmental Code, its amount would then be indicated.

12 โ€“ Method of payment


To pay for their order, the customer may choose from the payment methods referred to within the ordering interface. The following means of payment are notably accepted:


bank cards, Visa and Mastercard;


American Express;


Paypal.

If payment is refused by the customer's bank, the order cannot be finalised and the sale cannot be concluded.

Please note that gift cards (examples: Glady, Bimpli, etc.) may be used on all products sold on the delsey.com site, but they cannot be combined with another promotional code or used on items already discounted (Sales, Black Friday or any other commercial operation).

13 โ€“ Discount vouchers


Only one discount voucher is permitted per order. If you have applied several discount vouchers to your order, only one code will be applied to pay for your order. The other discount voucher will remain available for a subsequent order.

14 โ€“ Delivery


14.1 โ€“ Delivery terms


DELSEY will use its best efforts to deliver the product on the date or within the time indicated to the customer and, failing any such indication, at the latest within a maximum period of thirty (30) days from the day the customer placed their order.

Delivery times are specified to the customer when they place their order, according to the delivery method and delivery address chosen.

The products are delivered to the address indicated by the customer in the site's ordering interface.

Delivery will be carried out, at the customer's choice, according to the various methods and charges indicated on the site.

The carrier will send you a secure delivery code (PIN code) and a QR code by email or by SMS so that you can take receipt of your parcel. Remember to check your junk mail.

We remind you that you must UNDER NO CIRCUMSTANCES give this code to the delivery driver over the telephone. Always wait until you have taken receipt of the parcel and checked that it does indeed contain your purchases inside before confirming receipt of the order by giving the code to the delivery driver.

All risk of damage to the products is transferred to the customer at the time they take physical possession of those products.

14.2 โ€“ Delivery outside the stated time


Failing delivery on the date or on expiry of the stated period or, failing that, at the latest thirty days after the order was placed:

(i) after having given DELSEY formal notice to carry out the delivery within a reasonable additional period via the contact form: [link]

(ii) if DELSEY has not performed within that period, the customer may then cancel their order, by registered letter with acknowledgement of receipt requested or in writing on another durable medium, to the following postal address: DELSEY, Consumer Service Department, 25 rue du Gรฉnรฉral Foy 75008 Paris (France).

In this circumstance, the order is deemed cancelled upon receipt by DELSEY of the letter informing it of this cancellation, unless the order has been performed in the meantime.

14.3 โ€“ Delivery dispute


You have up to 14 days after the delivery date stated on the carrier's website to raise any delivery dispute.

15 โ€“ Right of withdrawal


15.1 โ€“ Period and scope


The customer has the statutory withdrawal period of fourteen (14) days (hereinafter the "withdrawal period") to notify their intention to withdraw, by generating a return slip as indicated in paragraph 14.2 of the T&Cs, without having to give reasons for their decision.

This withdrawal period runs from receipt of the product.

For orders covering several products delivered separately, the period runs from the day after receipt of the last product, batch or part.

If this period expires on a Saturday, a Sunday or a public or non-working holiday, it is extended until the next working day.

The withdrawal period is deemed to have been complied with when the product is returned no later than the day of its expiry, the postmark or carrier's date stamp being conclusive evidence.

Once the return slip has been generated, under the conditions referred to in paragraph 14.2 of the T&Cs, the customer then has a period of fourteen (14) days to return the products.

The customer is informed that the products must be returned:

in new condition in their original packaging; accompanied by the return slip; undamaged and complete; not spoiled or soiled; free from soiling, perforation, tearing, burns, discolouration or deformation; with all the accessories included in the product purchased and returned; with all the items representing the brand or the brand's model (logo, external brand label, etc.).

15.2 โ€“ Return of the products in connection with the exercise of the right of withdrawal


To return the product, the customer must generate a return slip, which it will be their responsibility to print and affix to the packaging used to return the products, and for this purpose:

(i) if they have a customer account, they will need to go to the details of their order and click on "return my order";

(ii) if they placed the order as a guest, they will need to click on the link contained in their order confirmation email.

The return slip will contain all the necessary data, in particular the customer's name and address, the return address, etc.

In all cases, and subject to compliance with the time limits set out above, customers may contact Delsey customer service via the following form: [link] or by telephone on the following number: 01 70 84 91 91.

To return the product, the customer must send the products back within the withdrawal period referred to in article 14.1 (the postmark or carrier's date stamp being conclusive evidence).

15.3 โ€“ Refunds


Where the customer exercises the right of withdrawal after delivery of their order, they will be refunded:

The products returned; The charges for the standard delivery initially offered by DELSEY; at the latest within a period of fourteen (14) days from the confirmation by DELSEY's teams of the condition of the returned products.

The return charges will remain payable by the customer if: The procedure described in 15.2 is not complied with and/or if they choose a carrier other than the one offered by DELSEY, They cancel an order whose total amount exceeds โ‚ฌ1,000 more than 12 hours after the order was confirmed.

In these latter cases, the return charges will be deducted from the amount owed to the customer.

The refund will be made using the same means of payment as that used by the customer when ordering, unless different arrangements have been expressly accepted by the latter.

15.4 โ€“ Defective or damaged products


The customer is required to check the condition of the products delivered. If the customer notes a defect or damage, they are invited to contact customer service via the following form: [this link]

16 โ€“ Guarantees


16.1 โ€“ Commercial guarantee


DELSEY offers its customers a commercial guarantee for a period whose terms are set out in the product pages, it being specified that the applicable guarantees are those in force at the time the product is purchased.

16.2 โ€“ Legal guarantee


Irrespective of the commercial guarantee granted, DELSEY remains bound by the legal guarantees provided for under the applicable national law, the details of which are accessible in the Appendix to the T&Cs.

17 โ€“ Rules relating to the processing of personal data


DELSEY attaches particular importance to the protection of your personal data. The collection, use and transfer of your personal data are carried out in accordance with the conditions described in our privacy policy.

The rules specific to telephone canvassing are set out in the Appendix to the T&Cs.

We collect your telephone number when you create an account, place an order or subscribe to our notifications. This information is essential in order to process your orders, inform you of their status, and personalise your shopping experience.

We use your telephone number to contact you regarding the details of your order and delivery updates, and to respond to any request from you. We may also use this number to send you promotional offers, information about our products and news, with your prior consent.

We do not sell, rent or share your telephone information with third parties without your explicit consent, unless this is necessary in order to provide our services (for example, with logistics partners for delivery).

By providing your telephone number, you consent to its use in accordance with this privacy policy. You may withdraw this consent at any time by amending the communication preferences in your account or by contacting us directly.

18 โ€“ Insurance


DELSEY certifies that it has taken out an insurance policy with a demonstrably solvent insurance company against the consequences of the civil liability that may fall to it by reason of bodily, material and immaterial damage caused to third parties arising on the occasion of or during the exercise of its activities, including in particular the management of the site, as well as after the delivery of its products.

The territorial scope is that of metropolitan France.

19 โ€“ Liability


DELSEY accepts no liability regarding any bugs or interruptions of the site. DELSEY grants no guarantee concerning all or part of the site, in particular relating to any direct or indirect damage arising from use of the site. The site may mention links to other external sources. Given that DELSEY cannot control these external sources,

DELSEY cannot be held liable for the content, products, services, advertising or items available on these external sources. DELSEY invites the user to read the terms of use that may be available on the said external sources.

DELSEY is liable as of right, towards the customer acting in the capacity of consumer, for the proper performance of the obligations arising from the T&Cs. However, DELSEY may not be held liable for the non-performance of its obligations under the T&Cs due to an event of force majeure.

Nor may DELSEY be considered liable where the improper performance or non-performance of the order is attributable to the unforeseeable and insurmountable act of a third party or to the act of the customer.

The provisions of this article shall survive in all cases.

20 โ€“ Settlement of disputes


The customer is informed by DELSEY of the possibility of using a conventional mediation procedure in the event of a dispute relating to these T&Cs. Indeed, in accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, DELSEY is a member of the Consumer Mediation Service of FEVAD (the French Federation of e-commerce and distance selling), whose contact details are as follows: FEVAD Consumer Mediator โ€“ BP 20015 โ€“ 75362 PARIS CEDEX 8 โ€“ https://www.mediateurfevad.fr.

21 โ€“ Applicable law


The T&Cs are governed by French law.

22 โ€“ Jurisdiction


The competent court will be the one having territorial jurisdiction under the applicable law.

23 โ€“ Updating of the T&Cs

APPENDIX


1 โ€“ Specific provisions relating to guarantees


Appendix to article D. 211-2 of the French Consumer Code:

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event that a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity and not the date on which it appeared.

Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the period of supply provided for. During this period, the consumer is required to establish only the existence of the lack of conformity affecting the digital content or the digital service and not the date on which it appeared.

The legal guarantee of conformity entails an obligation for the trader, where applicable, to provide all the updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity gives the consumer the right to the repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests the repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in return for the goods, if:

1ยฐ The trader refuses to repair or replace the goods;

2ยฐ The repair or replacement of the goods takes place after a period of thirty days;

3ยฐ The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or where they bear the cost of installing the repaired or replacement goods;

4ยฐ The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or rescission of the contract. The consumer is then not required to request the repair or replacement of the goods beforehand.

The consumer is not entitled to rescission of the sale if the lack of conformity is minor.

Any period during which the goods are out of use for the purpose of their repair or replacement suspends the remainder of the guarantee period until the repaired goods are delivered.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs in bad faith the implementation of the legal guarantee of conformity incurs a civil fine of a maximum amount of 300,000 euros, which may be increased to up to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects pursuant to articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept, or to a full refund in return for the goods.

2 โ€“ Specific provisions relating to telephone canvassing


Consumers who do not wish to be the subject of commercial canvassing by telephone are informed by these T&Cs of their right to register free of charge on the telephone canvassing opt-out list known as "Bloctel", available on the website http://www.bloctel.gouv.fr/.
